Denver Post, Righthaven drop suit against Autistic Blogger

Righthaven has dropped one of its lawsuits alleging copyright infringement of a Denver Post photo, “amid hugely negatively publicity,” according to Westword.

Righthaven dismissed its suit against Brian Hill, however, according to Westword, Righthaven said Hill’s health is “not a basis for excusing him of liability.” Hill is a “chronically ill, mildly autistic hobby blogger” who republished the Denver Post photo on his blog. Reporters without Borders was backing Hill in his motion to dismiss the suit.

Westword noted that the judge in the case has “struck from the record” a good chunk of RIghthaven’s dismissal filing because it was “immaterial and impertinent,” or as Westword described it, “attacks on the young blogger.”

Righthaven defended itself in the stricken case “Righthaven has acted in good faith” and “Was unaware of the Defendant’s alleged medical condition prior to filing suit.”
